Terms & Conditions (Projects & Services)


Company: Coco Pools (“Company,” “we,” “our,” or “us”)

These Terms & Conditions apply to all pool construction, remodeling, resurfacing, and outdoor living projects performed by Coco Pools. By entering into an agreement or making a payment, the Client (“Customer,” “you”) agrees to the following terms.


1. Scope of Work

All work will be performed as outlined in the written estimate, proposal, or contract provided by Coco Pools. Any services not specifically listed are not included and may require a separate agreement or change order.


2. Estimates & Pricing

  • All estimates are based on current material and labor costs
  • Prices are subject to change if project scope changes
  • Unforeseen conditions (soil issues, structural damage, hidden plumbing issues, etc.) may result in additional costs
  • Estimates are valid for [30 days] unless otherwise stated

3. Payment Terms

  • A deposit is required before work begins
  • Progress payments may be required at various project milestones
  • Final payment is due upon substantial completion

Late Payments:

  • Late payments may incur fees and/or interest
  • Work may be paused until payment is received

Failure to pay may result in legal action and/or a construction lien as permitted under Florida law.


4. Change Orders

Any changes to the original scope of work must be approved in writing.

  • Change orders may affect cost and timeline
  • Verbal requests are not considered approved changes
  • Work will not proceed on changes until written approval is received

5. Project Timeline & Delays

6. Permits & Inspections

  • The Customer agrees to provide access for inspections as needed

7. Site Access & Responsibilities

The Customer agrees to:

  • Provide clear and safe access to the job site
  • Ensure utilities (water, electricity) are available if required
  • Remove pets, furniture, or obstacles from the work area

Coco Pools is not responsible for damage to items left in construction zones.


8. Unforeseen Conditions

During construction or renovation, hidden issues may arise, including:

  • Structural damage
  • Soil instability
  • Plumbing or electrical issues

These conditions may require additional work and cost. The Customer will be notified before proceeding.


9. Warranties

Workmanship Warranty

Coco Pools provides a limited warranty on workmanship for a period of time from project completion.

Manufacturer Warranties

Equipment and materials (pumps, finishes, etc.) are covered by manufacturer warranties.

Warranty does NOT cover:

  • Normal wear and tear
  • Improper maintenance or chemical imbalance
  • Damage caused by third parties or natural events

10. Pool Maintenance Responsibility

Once the pool is filled and operational, the Customer is responsible for:

  • Proper chemical balancing
  • Routine maintenance and cleaning

Failure to maintain proper water chemistry may void warranties.


11. Cancellations & Refunds

  • Deposits may be non-refundable once materials are ordered or work has begun
  • Cancellation requests must be submitted in writing
  • Any completed work will be billed accordingly

12. Right to Stop Work

Coco Pools reserves the right to stop work if:

  • Payments are not made as agreed
  • Job site conditions are unsafe
  • Customer interference prevents work completion

13. Limitation of Liability

Coco Pools is not liable for:

  • Indirect or consequential damages
  • Delays caused by third parties or external factors
  • Pre-existing conditions or hidden defects

Maximum liability is limited to the amount paid for services.


14. Indemnification

The Customer agrees to indemnify and hold harmless Coco Pools from any claims, damages, or liabilities arising from the project, except in cases of gross negligence.


15. Dispute Resolution

Any disputes shall first attempt to be resolved through good-faith negotiation.

If unresolved:

  • Disputes may be handled through mediation or arbitration
  • Legal proceedings shall take place in the State of Florida

16. Force Majeure

Coco Pools is not responsible for delays or failure to perform due to events beyond our control, including natural disasters, hurricanes, labor strikes, or supply chain disruptions.
